GENERAL CONDITION OF SALES

 

The Conditions of sales told in the following document are applied to all the sales of products proposed by the company Living Giardini & Co srl, uniquely on its website. Ordering a product on the website www.lavandadellago.it involves, consequently, the full acceptation from the Customer, who subscribes to have taken note of them before placing the order.

Conform to the article L.111.1 of the Consumer’s Code, Living Giardini communicates the following information:

Products

The products on sale on the website www.lavandadellago.it constitute the offer of Living Giardini & Co SRL. The images of the products presented in our website are only examples, nevertheless the company engages itself to let the pictures be the most near to the real products offered thus not causing ambiguity on the dimensions, weight and quality.

Living Giardini reserves the right to modify its offer at any time.

 

 

We invite the customer, before using the purchased product, to read the list of ingredients of the product with the trademark LAVANDA DEL LAGO to verify if they are suitable to one’s personal use.

In case of particular conditions of the skin, it is recommended to consult one’s personal doctor, before using any product offered by Living Giardini & Co SRL.

Purchaser 

Living Giardini & Co SRL proposes the sale of its products of LAVANDA DEL LAGO trademark through the website www.lavandadellago.it to all consumers having legal skill enough and necessary to complete a purchasing, which can be checked by the company itself. 

Contract

The Customer, before placing the order, has the chance of checking the items he puts in the trolley and correct eventual mistakes. Once the Customer digits on “confirm and proceed”, he asserts to have knowledge of the conditions of purchasing and sale, of the technical characteristic of products and of the shipping conditions.

The payment can be done by credit card, prepaid card, Pay Pal, cash on delivery, and bank transfer. The sale will be definite at the order’s confirmation from the part of the Customer, taking into account the chance that the order could be cancelled. 

Following the order’s confirmation, the Customer will receive a mail message with the summary of the data entered and of the products ordered. The mal address on which the Customer will receive the mail message is confirmed also during the registration to the website; in case of wrong address Living Giardini & Co SRL will not be responsible.

Living Giardini & Co SRL assumes the right of cashing the total amount of the order for what concerns the payment in the terms accepted by the website, when the Customer is informed by a mail about the shipment of his order.

Shipment

Living Giardini & Co SRL delivers all orders on the website, on the National and European territory and in Switzerland. For other countries, the enquiries of order must be sent by mail to the following address salesaccount@lavandadellago.it  

The products will be sent to the address that the Customer has indicated during the registration on the website. The quote of the shipping fee includes VAT. 

The maximum shipping time is of 30 days, from the date of the order confirmation, for the National and European shipments.

Normally the delivery time is of 2 working days from the receipt of the mail message of the shipment confirmation, for shipments in Italy.

For orders to European countries, the delivery time is of about 4/6 working days from the receipt of the mail message of the shipment.

These delivery times are intended for orders done within 12 a.m., for an article available on stock, and by a payment through Pay Pal or Credit Card. 

For orders done with other terms of payment, the average times can vary, in case of payment by bank transfer, the delivery time is of 2 working days from the receipt of the payment itself on the account of Living Giardini & Co SRL for shipments in Italy, while it will be of 4/6 working days for shipments in European Countries. 

For shipments in Italy, the price, VAT included, is as follows:

• For orders between 0 and 25 Euros, the shipping amount is of 7 €
• For orders between 25,01 and 50 Euros, the shipping amount is of 3 €
• For orders over 50,01 Euros, no shipping costs will be charged.

 

For shipments in European Countries, the price, VAT included, is as follows:

• For orders between 0 and 50 Euros, the shipping amount is of 16 €
• For orders between 50,01 and 100 Euros, the shipping amount is of 5 €
• For orders over 100,01 Euros, no shipping costs will be charged.

The Customer can check the status of his shipment through the Tracking Number that he will receive by e-mail from the carrier itself, or contacting directly the office of Living Giardini & Co SRL. 

Any order confirmed and transmitted by the carrier cannot be cancelled.

Withdrawal

Once received, whenever a part of the totality of the order is not satisfying the Customer, he has the right to withdraw the contract within 14 days from the receipt of the products, in accordance with the art.65 of the Consumer’s Code (D.lgs n.206/2005)

To assert this right, he must send a detailed e-mail by notifying the decision of sending back the products to the following address: info@lavandadellago.it

The products that the Customer wants to send back must be shipped in the original packaging and never used, gifts included if there are.

The refund will be done by Living Giardini& Co SRL through the same terms of payment used by the Customer.

In case of withdrawal, Living Giardini & Co SRL, will repay the full amount, shipment costs included.

The shipping costs for the withdrawal will be at the Customer’s charge. 

We remind that the refund will be done only once the goods will be received at the following address: Living Giardini & Co SRL, Via Cidneo, 16 25081 Bedizzole (BS), maximum within 14 days after having communicated the decision of withdrawal and after the Company will have had the chance of checking the goods status. 

Payment

For the products bought on the website www.lavandadellago.it it is possible to pay by the following methods:

• Pay Pal and Credit Cards accepted by Pay Pal (safe payment)
• Bank transfer, by means of transfer to the following IBAN code: IT56Z0869254170 049000002483
• Cash on delivery, with direct payment to the carrier at the time of the delivery. This payment has an extra cost of 5,00 €

Check of the transaction

Living Giardini & Co SRL, will reserve itself the right to contact the Customer asking to check the validation of the transaction (identity and/or address) 

The Customer will have to supply the data within 48 hours from the request of Living Giardini & Co SRL; if denied or delayed, the order will be cancelled. 

Right of ownership

Living Giardini & Co SRL will reserve itself the right of ownership of the products the Customer orders until the receipt of the total amount of the payment.

Customers service and complaints 

For any explanation or complaint on the fulfillment of the contract, the Customer can contact the customer service at the following address: info@lavandadellago.it 

Availability of the products

Living Giardini & Co SRL will attempt to assure the Customer the real availability of its items on the website. 

The products’ offers will be valid until they will appear on the website and/or until running out of stock.

If an ordered product will not be really available when packing, Living Giardini & Co SRL will contact the Customer to inform him and eventually arrange the refund or the substitution with another one of the same cost or cancel the whole order.

 

Legal warranty of the products

In case of non-conform or faulty product, the Customer must send a letter or describe his claim to the address of Living Giardini & Co SRL- Via Cidneo 16, 25081 Bedizzole (BS) or by e-mail to the address: info@lavandadellago.it 

In case of non-conformity, Living Giardini & Co SRL will substitute the same product or with one of an equivalent price. The Customer will have to send the faulty product to the following address: Living Giardini & Co SRL- Via Cidneo 16, 25081 Bedizzole (BS). 

The substitution will have to be done within 30 days from the receipt of the product. 

Living Giardini & Co SRL reminds its Customers that the cosmetics products LAVANDA DEL LAGO and the Foodstuffs, must be kept far from damp, out of intense light and not exposed to too high temperatures.

They can be subject to a best before end date. So, the Cosmetic products and Foodstuffs which have not been preserved in the specified indications, will be not included in the warranty.

 

Liability 

Any dispute or claim relating to any contract between the Customer and Living Giardini & Co SRL will be resolved by a binding arbitration.

Any sale of products on the website www.lavandadellago.it   is subject to the Italian Legislation, whichever will be the country of the buyer or the place where the order is placed.

Any dispute or claim relating to interpretation, dispatch or withdrawal of a contract between the Customer and Living Giardini & Co SRL will be under the exclusive jurisdiction of the Court of Brescia.

 

Privacy policy, data protection and right to complaint

Living Giardini & Co SRL gathers and treat personal data for the fulfilment of the orders and other purposes described in the Privacy Policy section.

The Customer can modify or eventually delete his data and has the right, at any time, to cancel from the newsletter.

Amendments of the conditions of sale

Living Giardini & Co SRL reserves the right to make changes to the actual conditions of sale at any time.

In case of amendments to the condition of sales, these will not be valid for orders placed before.

Being the owner of all the rights of intellectual and industrial property,  Living Giardini & Co SRL has the exclusive right to use the website www.lavandadellago.it and of the trademark LAVANDA DEL LAGO

All contents, such as photos, texts, images, graphics, button icons, videos, included or made available on the website are exclusive property of Living Giardini & Co SRL.

You may not extract, publish, modify, transmit nor adapt them without the express consent of the property.

Nobody may use promotions, hidden texts, meta tags, name or trademark of Living Giardini & Co SRL.   without any written consent.

Feedback on our products

Living Giardini & Co SRL reserves the right to publish the Customers opinions on the items LAVANDA DEL LAGO unless their content is not comprehensible, obscene, defamatory or racist. Besides it can also modify the length, the spelling of some terms for an improvement of the editing of the website.
